外国人在中国就业发生劳动争议应如何适用法律?(一)

      适用哪国的法律?Which country's law should beapplied to?
     
      根据《中华人民共和国涉外民事关系法律适用法》第43条的规定可知:“劳动合同,适用劳动者工作地法律;难以确定劳动者工作地的,适用用人单位主营业地法律。劳务派遣,可以适用劳务派出地法律。”所以,如果外国人在华就业并且工作地点为中国,劳动争议应当适用中国的法律。
     
      According to the article 43 of < Law of the People's Republic of China on the Application of Laws to Foreign-related Civil Relations>: “For labour contracts, the labourers' place of work shall apply; if such place of work is difficult to determine, the laws of the employers' principal place of business shall apply. For labour dispatches, the laws of the place in which the labours are sent shall apply.” Therefore, if foreigners work in China and the working place is in China too, labor disputes should apply Chinese law.“
     
      劳动关系是否受《劳动法》的保护?Are labor relations protected by the ?
     
      外国人在中国发生的劳动争议后,根据是否办理就业证分为两种情况:
     
      Foreigners'labor disputes in China can be divided into two cases on the basis of whether the work permit is obtained:
     
      · 已办理就业证的,应认定其和用人单位建立了劳动关系,若其与单位发生用工矛盾,适用中国劳动法的相关规定解决。
     
      If the foreigner employment permit has been obtained, a labor relationship has been established between two parties. If the foreigner has conflicts with the employer, the relevant provisions of Chinese labor law should be applied.
     
      · 未办理就业证的,依《最高人民法院关于审理劳动争议案件适用法律若干问题的解释(四)》第十四条,”外国人、无国籍人未依法取得就业证件即与中国境内的用人单位签订劳动合同,以及香港特别行政区、澳门特别行政区和台湾地区居民未依法取得就业证件即与内地用人单位签订劳动合同,当事人请求确认与用人单位存在劳动关系的,人民法院不予支持。持有《外国专家证》并取得《外国专家来华工作许可证》的外国人,与中国境内的用人单位建立用工关系的,可以认定为劳动关系。“
     
      If the foreigner employment permit has not been obtained, according to article 14 of : ”Where a foreigner or a Stateless person failed to obtain an employment permit pursuant to the law before entering into a labour contract with an employer in China, or a resident from the Hong Kong Special Administrative Region, Macao Special Administrative Region or Taiwan failed to obtain an employment permit pursuant to the law before entering into a labour contract with an employer in Mainland China, and the parties concerned request for confirmation of employment relationship with the employer, the People's Court shall not support the request. Where a foreigner holding a “Foreign Expert Certificate” and obtaining an “Employment Permit for Foreign Expert Working in China” establishes an employment relationship with an employer in China, the employment relationship may be deemed established.“
     
      即一般情况下,违法就业之外国人不能享有中国劳动法项下对于劳动者的相关保护,特别是解雇保护。
     
      In general, foreigners who have been employed illegally can not enjoy the protections under the Chinese labor law, especially the dismissal protection.
